1. Access and Hosting

You can visit Agency Croatia’s website without providing any personal information. Each time you visit a website, the web server only automatically saves a so-called server log file, which contains, for example, the name of the requested file, your IP address, the date and time of the request, the amount of data transferred and the requesting provider (access data) and documents the request. This access data is evaluated exclusively for the purpose of ensuring the trouble-free operation of the site and improving our offer. We collect personal data if you voluntarily provide us with this information when contacting us (e.g. inquiry, contact form, or e-mail). Mandatory fields are marked as such because in these cases we need the data to process your request, booking, or contact and you can not send the request or contact without their information. Which data collected can be seen from the respective input forms. We use the data provided by you in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO for the preparation of offers, the booking process, and the general processing of your requests. After complete processing of the inquiry or booking, your data will be restricted for further processing and deleted after the expiry of the retention periods under tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this statement.

4. E-Mail Inquiries

If you send us an inquiry by e-mail, we assume that you do this voluntarily. In order to process your request, we must store it with us (e-mail program). Nevertheless, you have the possibility and the right to revoke your consent or to send us your change requests at any time.

5. Disclosure of Data to Third Parties

We may share your personal information with:

  • Owners or agents of vacation properties you have booked,
  • credit/debit card and payment service providers,
  • external service providers (e.g. IT and support service providers, marketing service providers, resorts, management companies),
  • government agencies, regulators, and other authorities,
  • professional advisors, including bankers, lawyers, auditors, accountants, and insurers who provide services to us.

 

We will require third parties to process your personal information in accordance with data protection laws. If a third party is acting on our behalf, we will not allow them to use your data for their own purposes and will ensure that they put in place sufficient security measures to protect your data.

6. International Transfer of Data

We may transfer your data to countries outside the EU to provide our services. We will only transfer your data outside the EU if one of the following transfer bases applies:

Adequacy Decision, standard contractual measure, and other measures, if applicable. If it is necessary for contractual purposes, for example, if the owner of the vacation property you have booked is located outside the EU, we must transfer your data there.

7. Transfer of Data to Collection Companies

In order to fulfill the contract in accordance with Art. 6 para. 1 p. 1 lit. b DSGVO, we will pass on your data to a commissioned collection agency if our payment claim has not been settled despite a previous reminder. In this case, the debt will be collected directly by the collection agency. In addition, the transfer serves to protect our legitimate interests in the effective enforcement of our payment claim in accordance with Art. 6 para. 1 p. 1 lit. f DSGVO.

8. Cookies And Web Analysis

8.1 Cookies

Cookies are small files that are stored on your hard drive, where a unique ID is stored, which allows you to log in automatically. However, if you would like to prevent the use of cookies in general, your browser offers the possibility to prevent the acceptance and storage of new cookies. You can use this service in this case. a) Description and scope of data processing

Our website uses cookies. Cookies are text files that are stored in the Internet browser or by the Internet browser on the user’s computer system. When a user calls up a website, a cookie may be stored on the user’s operating system. This cookie contains a characteristic string of characters that enables the browser to be uniquely identified when the website is called up again. 9.1 Google reCAPTCHA

For the purpose of protection against misuse of our web forms as well as against spam, we use the Google reCAPTCHA service in the context of some forms on this website. Google reCAPTCHA is an offer of Google Ireland Limited, a company registered and operated under the laws of Ireland with its registered office at Gordon House, Barrow Street, Dublin 4, Ireland. (www.google.de). By verifying a manual input, this service prevents automated software (so-called bots) from carrying out abusive activities on the website. In accordance with Art. 6 para. 1 p. 1 lit. f DSGVO, this serves to protect our legitimate interests in the protection of the website against misuse and in a trouble-free presentation of our online presence, which outweighs our interests in the context of a balancing of interests.

Google reCAPTCHA uses, by means of a code embedded in the website, a so-called JavaScript, within the scope of the verification, methods that enable an analysis of your use of the website, such as cookies. The automatically collected information about your use of this website, including your IP address, is usually transferred to a Google server in the USA and stored there. In addition, other cookies stored by Google services in your browser are evaluated by Google reCAPTCHA. A readout or storage of personal data from the input fields of the respective form does not take place.

Insofar as information is transferred to Google servers in the USA and stored there, the American company Google LLC is certified under the EU-US Privacy Shield. Based on this agreement between the USA and the European Commission, the latter has determined an adequate level of data protection for companies certified under the Privacy Shield.

The script code “Google Fonts” is integrated into this website. b) Our online presence on Facebook, TikTok, Instagram

Agency Croatia’s presence on social networks and platforms serves better, more active communication with our clients and interested parties. Agency Croatia informs there about the various accommodations, tours, and specialties of Istria.

When visiting online presences on social media, your data may be automatically collected and stored for market research and promotional purposes. From this data, so-called usage profiles are created using pseudonyms. These can be used, for example, to place advertisements within and outside the platforms that presumably correspond to your interests. Cookies are generally used on your terminal device for this purpose. In these cookies, the visitor behavior and the interests of the users are stored. This serves according to Art. 6 para. 1 lit. f. DSGVO to protect our legitimate interests in an optimized presentation of our offer and effective communication with customers and interested parties, which prevail in the context of a balancing of interests. If you are asked by the respective social media platform operators for consent (agreement) to the data processing, e.g. by means of a checkbox, the legal basis for the data processing is Art. 6 (1) lit. a DSGVO. Insofar as the aforementioned social media platforms have their headquarters in the USA, the following applies: For the USA, there is an adequacy decision of the European Commission. This goes back to the EU-US Privacy Shield.

  • Pursuant to Art. 15 DSGVO, the right to request information about your personal data processed by us to the extent specified therein;
  • pursuant to Art. 16 DSGVO, the right to request without undue delay the correction of inaccurate or completion of your personal data stored by us;
  • in accordance with Art. 17 DSGVO, the right to request the erasure of your personal data stored by us, unless further processing is necessary to
    • for the exercise of the right to freedom of expression and information;
    • for the fulfillment of a legal obligation;
    • for reasons of public interest; or
    • is necessary for the assertion, exercise or defense of legal claims;
  • in accordance with Art. 18 DSGVO, the right to request the restriction of the processing of your personal data, insofar as
    • the accuracy of the data is disputed by you;
    • the processing is unlawful, but you refuse its erasure;
    • we no longer need the data, but you require it for the assertion, exercise or defense of legal claims, or
    • you have objected to the processing in accordance with Art. 21 DSGVO;
  • pursuant to Art. 20 DSGVO, the right to receive your personal data that you have provided to us in a structured, commonly used and machine-readable format or to request that it be transferred to another controller;
  • pursuant to Article 77 of the GDPR, the right to lodge a complaint with a supervisory authority. As a rule, you can contact the supervisory authority of your usual place of residence or workplace or our company headquarters for this purpose.

11. Right of Objection

Insofar as Agency Croatia processes personal data as explained above in order to protect our personal data as described above in order to protect our legitimate interests, you may object to such processing with effect for the future. If the processing is carried out for direct marketing purposes, you can exercise this right at any time as described above. If the processing is carried out for other purposes, you only have the right to object if there are grounds arising from your particular situation. After you have exercised your right to object, your personal data will no longer be processed for these purposes unless Agency Croatia can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or if the processing serves the purpose of asserting, exercising or defending legal claims. This does not apply if the processing is for direct marketing purposes. Then your personal data will not be further processed for this purpose.
